Er zijn drie manieren om uit een arbeidsconflict te komen:
- Mediation | Je werkgever en jij proberen met behulp van een mediator het conflict structureel op te lossen;
- Ontslag met wederzijds goedvinden | Je werkgever en jij zijn beiden akkoord met ontslag en proberen in goed overleg tot goede voorwaarden voor ontslag te komen door middel van een vaststellingsovereenkomst;
- Procederen | Je gaat naar de rechter om je ontslag aan te vechten of er het best haalbare uit te halen.
In alle drie gevallen kunnen wij je helpen door een goede strategie te bepalen, de hoogte van de transitievergoeding te bepalen, een ontslagvergoeding uit te onderhandelen en je van de juiste adviezen te voorzien. WAT MOET JE NIET DOEN?
- Teken nooit direct een vaststellingsovereenkomst | Laat deze altijd door een ervaren jurist bekijken. Vaak valt er veel meer uit te halen dan je werkgever je aanbiedt. Of zitten er fouten in waardoor je geen recht meer hebt op WW. En laat je ook niet gek maken door een strakke deadline, want daar kan je werkgever je niet aan houden. Wees wel redelijk en koppel terug wanneer je werkgever een reactie kan verwachten;
- Ga niet akkoord met betaald verlof | Blijf altijd beschikbaar voor werk en ga nooit zonder overleg met je arbeidsrecht advocaat akkoord met een non-actiefstelling of vrijstelling van werkzaamheden. Dit kan achteraf worden opgevat als voorsortering op je ontslag en gezien worden als een indirecte schulderkenning;
- Zorg ervoor dat het conflict niet onnodig escaleert | Wanneer jij aantoonbaar zorgt voor escalatie van het probleem heeft dat als consequentie dat je werkgever in het gelijk wordt gesteld.
