EMPLOYEE UNFAIRLY DISMISSED DURING REORGANIZATION POSTNL
Mr. Elise van Es has been vindicated on appeal by the Court of Appeal in a case against PostNL, where an employee was wrongfully dismissed during reorganization. Also, PostNL must include overtime in severance compensation. Good news for dismissed PostNL employees who structurally worked a lot of overtime. In a case involving an employee who was wrongfully terminated, the Hague Court of Appeal ruled that those overtime hours must be included in compensation and reinstatement of the employment contract.

DOES DORMANT EMPLOYMENT LEAD TO BAD EMPLOYMENT?
A person who enters the sickness law after a work accident can simply end up in "dormant employment" after two years. Then the employer does not have to pay any transition compensation. Is that allowed? Cor van der Linden has been in such dormant employment for years. He suffered an industrial accident in 2015. For the first two years he was paid 100% of his salary through the sickness law. After two years, Cor would theoretically have to be laid off, as the accident had left him 100% disabled and thus unable to perform his job. Since Cor had worked for the company since 1999, he was therefore entitled to a hefty transition allowance. For each year worked, Cor should receive one month's salary.

STAND UP FOR YOUR INTERESTS IN BURNOUT
One in seven employees has burnout symptoms and that number is increasing, according to research by TNO. Especially in the hospitality, education and health care sectors, there are many sick days. That unpleasant situation can sometimes last a long time. What should you do if you end up in a burnout and how do you prevent a labor conflict? According to psychologist Maud van Aalderen of the Netherlands Institute of Psychologists, the main symptoms of burnout are extreme exhaustion, a lack of interest in others, difficulty organizing your life and not having the need to take things on. In her own practice, she sees an increase in burnout. "I see as a cause that the pace of work at companies is increasing and the fact that employees have to be constantly available. In addition, since 2013 there has been more focus on burnout.

MR. ELISE VAN ES EXPLAINS THE BALANCED LABOR MARKET ACT (WAB)
Mr. Elise van Es (attorney at employment law) will give an explanation of the "Wet Arbeidsmarkt in Balans" or WAB, which will come into effect on January 1, 2020. The main changes such as the cumulation of grounds, the changes for on-call contracts are discussed by Elise van Es. She also discusses the lower transitional compensation that will apply as of January 1 and how this relates to bad employment practices in case of wrongful termination. Finally, she discusses the Supreme Court ruling on dormant employment. Van Es expects that employees will still be able to file quite a few claims against employers based on bad employment practices.
